Agreement is entered into by and between Ellen Finn (the Coach) and you (the Client). The Coach and the Client agree to enter into the coaching services and professional relationship specified in this document.

COACH-CLIENT RELATIONSHIP

1. The Coach acknowledges that the Client is the expert in navigating their own life, based on personal preferences and experiences.

2. The Client is solely responsible for decisions, actions, choices, lifestyle changes, and results throughout the program.

3. The Client acknowledges that the Coach acts as a facilitative partner and that the Coach’s primary role is not that of a content expert or educator or to diagnose, advise, or instruct the Client on what to do.

4. The Client agrees to communicate honestly and dedicate their time and energy to participating fully in the Program.

SERVICES

The services for each product vary.

PROGRAM FEES

The program fee will be as shown for each programme. You will either pay in full or pay on a payment plan. The client agrees that all payments under this payment plan are legally binding and must be paid on time. There will be a penalty fee for any overdue payments.

PROGRAM CANCELLATION POLICY

There will be no refunds if you withdraw from the program.

The Coach reserves the right to cancel the program if at any point the Coach feels it’s not advantageous for the program to continue. If this happens, the Client is responsible for the pro rata share of coaching services received. 

DISCLAIMERS 

The Client understands that the role of the Coach is not to prescribe or assess specific meal plans; provide healthcare, medical, or nutrition therapy services; or diagnose, treat, or cure any disease, condition, or other physical or mental ailment of the human body. Rather, the Coach is a mentor and guide who’s been trained in health coaching and behavioral change to help clients reach their own health goals by helping clients devise and implement positive, sustainable lifestyle changes. 

The Client understands that the Coach is not acting in the capacity of a doctor, dietitian, nutritionist, psychologist, psychotherapist, or other licensed or registered professional, and that the Program is not intended to replace services performed by these professionals. 

The Client acknowledges that, if under the care of healthcare professionals, the Client should discuss any dietary changes or potential dietary supplement use with those professionals. If the Client currently uses prescription medications, the Client should not discontinue any prescription medications without first consulting the Client’s prescribing healthcare provider.

The Client has chosen to work with the Coach and understands that coaching services, including any information or resources received, are not medical advice nor meant to replace services delivered by licensed health professionals.

The Client understands that the Coach is not a financial advisor, accountant, or licensed financial professional. Any examples, strategies, or discussions relating to money are illustrative and are not guarantees of specific financial outcomes. The Client acknowledges that all financial decisions, actions and outcomes are made solely at their own discretion and risk. The Client is responsible for seeking independent professional advice from a qualified financial professional where appropriate. To the fullest extent permitted by law, the Coach disclaims any liability for financial outcomes, losses, or decisions made by the Client.

The details of the program may change slightly. I make no promises around results, the client is in charge of their actions and how much they choose to participate.

PERSONAL RESPONSIBILITY AND RELEASE OF HEALTHCARE-RELATED CLAIMS

The Client acknowledges that the Client takes full responsibility for the Client’s life and well-being, as well as the lives and well-being of the Client’s family and children (where applicable), and all decisions made during and after the Program.

The Client expressly assumes the risks of the Program, including the risks inherent in making dietary and/or lifestyle changes. The Client releases the Coach from any and all liability, damages, causes of action, allegations, suits, sums of money, claims and demands whatsoever, in law or equity, which the Client ever had, now has, or will have in the future against the Coach, arising from the Client’s past or future participation in, or otherwise with respect to, the Program, unless arising from the gross negligence of the Coach.

INTUITIVE SERVICES DISCLAIMER (Tarot/Oracle Readings)

The Client acknowledges that any tarot, oracle, or intuitive reading provided by the Practitioner is offered as a form of personal insight, guidance, and spiritual interpretation based on intuition, energy, and symbolic meaning.

The Client understands and agrees that:

All readings are subjective in nature and may be interpreted in multiple ways.

The information provided is not a statement of fact, guarantee, or prediction of future events or outcomes.

The Practitioner does not claim to provide legal, medical, financial, psychological, or other professional advice.

Any decisions or actions taken by the Client following a reading are made at their own discretion and sole responsibility.

The Client agrees to use their own judgment and discernment when interpreting the information provided and acknowledges that the Practitioner is not liable for any outcomes, decisions, or actions taken as a result of the reading.

By engaging in these services, the Client confirms they understand and accept that intuitive readings are for guidance & energetics purposes to use at their own free will with discretion.

SUBCONTRACTOR LIABILITY & RESPONSIBILITY

Independent Contractor Status

The Client acknowledges and agrees that any subcontractor, contractor, or third-party service provider (“Subcontractor”) engaged in connection with the services is an independent entity and is not an employee, partner, or agent of Ellen Finn (empoweredwithEffy)

Subcontractor Responsibility

All services provided by the Subcontractor are delivered under the Subcontractor’s own business entity 

The Subcontractor is solely responsible for the delivery, quality, performance, and outcomes of their services.

Limitation of Liability

To the fullest extent permitted by law, Ellen Finn (empoweredwitheffy) shall not be liable for:

any acts, omissions, negligence, or misconduct of the Subcontractor;

any injury, loss, damage, or claim arising from or in connection with the Subcontractor’s services;

any failure of the Subcontractor to meet agreed standards, timelines, or expectations.

Indemnity

The Client agrees that any claims, disputes, damages, or liabilities arising from the Subcontractor’s services are to be directed solely to the Subcontractor’s business entity listed above.

The Client releases and indemnifies Ellen Finn  from and against any such claims, losses, damages, or expenses.

Client Acknowledgement

By engaging in services where a Subcontractor is involved, the Client acknowledges that they are entering into a separate service relationship with the Subcontractor and accepts all associated risks.

CONFIDENTIALITY

The Coach will keep the Client’s information private and will not share the Client’s information with any third party without the Client’s written consent unless required by law. The Coach may use content for marketing but will not disclose the Client’s name as a reference in marketing materials without the Client’s consent.

If part of a group or watching trainings, the client will keep all other members information private, what others share within the group will be treated as confidential. The client will treat other members of the group with kindness and respect. 

CONFIDENTIALITY

CONTENT & COPYRIGHT

All content is created by Ellen Finn (Empowered with Effy). My website, courses, trainings, resources and content may not be copied, distributed or recreated. They are only to be accessed and used by the purchaser. The client agrees not to share any material with anyone outside of the program.

ARBITRATION, CHOICE OF LAW, AND LIMITED REMEDIES

All disputes arising out of or in connection with the present Program Agreement shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules.

By joining this programme you are agreeing to these terms and conditions.

By doing so, the Client acknowledges that: (1) the Client has received a copy of this letter Agreement; (2) the Client has had an opportunity to discuss the contents with the Coach and, if desired, to have it reviewed by an attorney; and (3) the Client understands, accepts, and agrees to abide by the terms hereof.
